On January 10, 2008, named Plaintiffs Connie Wineland, Maria Ward, Rose Mose, Tammy McKinnis, Lisa Smith, April Hicks and Teresa Arenas filed a class and collective action lawsuit against Defendant Casey’s General Stores ("CGS").  In this lawsuit, Plaintiffs seek to recover unpaid wages and other damages on behalf of all CGS cooks and cashiers who worked unpaid time off-the-clock, missed break periods, and were deprived of overtime wage for the time worked in excess of 40 hours per week.  The lawsuit charges CGS with violations of multiple federal and state laws by failing to keep accurate time records, failing to provide required meal and rest break periods and failing to pay regular and overtime wages earned.

Plaintiffs allege that this lawsuit applies to thousands of current and former CGS employees across the United States who were designated, paid or employed as a cook or cashier from January 10, 2005 to the present.

Under federal and state wage and hour laws, employees are entitled to minimum wage for all hours worked and time-and-a-half pay for each hour over 40 hours worked in a workweek, unless the employer can demonstrate they are properly exempt from these requirements.  The federal Fair Labor Standards Act "FLSA" and state wage and hour laws require employers to maintain accurate records of hours actually worked by its employees.

In this case, Plaintiffs allege that CGS used a “schedule-based” time keeping system that did not account for all hours worked by its cooks and cashiers.  Plaintiffs allege that they and other similarly-situated employees worked unpaid regular and overtime hours off-the-clock for CGS performing a variety of duties.  Plaintiffs also allege they were required to work through their break periods without pay.
